SUBJECT
An Ordinance approving the record plat of Gardner Subdivision.

EXECUTIVE SUMMARY

The attached ordinance approves the record plat of Gardner Subdivision.

BACKGROUND/DISCUSSION
A record plat has been submitted for Gardner Subdivision, located on Timber Creek Drive.  The subdivision is zoned R-1 (Single-family Suburban Residential District).  The plat combines two existing lots into one new lot.  As part of the plat, an existing 10’ utility easement is being eliminated.  The plat shows a variance for a reduced rear yard building setback (25’ minimum required; 15’ proposed).  City staff supports the variance due to the location of the existing house, which is more than 15’ but less than 25’ from the west lot line.  Currently, the lot on which the house is located is considered an interior lot.  The yard in question is considered a side yard with a 6’ minimum required width.  Once the lots are combined, the new lot will be a corner lot, and the yard will change to a rear yard with a 25’ minimum required width per the Zoning Ordinance.  Approval of the variance as part of the plat approval will allow the house to remain in compliance with the setbacks.

STAFF RECOMMENDATION
The staff report to the Planning and Zoning Commission recommended approval.

BOARD OR COMMISSION RECOMMENDATION
The Planning and Zoning Commission, at its December 10, 2014 regular meeting, recommended approval of the record plat with a vote of 9 in favor, 0 in opposition, and 0 abstaining.
