SUBJECT
BILL NO. 15-01, an Ordinance amending Section 15-337 of the Code of Ordinances of the City of Cape Girardeau, Missouri, regarding rooms to lease, let, hire or rent. First Reading.

EXECUTIVE SUMMARY

With recent efforts to increase Residential Rental Licensing enforcement, it became apparent some minor amendments to the "Definitions" section of the Rental Licensing Ordinance are necessary.  The proposed amendments include a revision to the definition of "Code Official" to provide for a "deputy or designee" to carry out the enforcement of the Ordinance.  In addition, the City Prosecutor requested the addition of a defintion of "Violation" as "A failure to meet any requirement set forth in any section or subsection of this Chapter as determined by the code official or his deputy or designee."

BACKGROUND/DISCUSSION
Development Services staff has been working diligently with the City Attorney's office to actively enforce the Residential Rental Licensing ordinance.  To streamline the enforcement process, it became apparent the definition of "Code Official" should be revised to include a "deputy or designee" to assist with the administration and enforcement of the code.  Currently, the Rental Licensing Inspector must refer citable offenses to the Code Official to take action.  The proposed change will allow the Rental Licensing Inspector to send Rental License Suspension letters and various other enforcement actions which will streamline the process.

SUSTAINABILITY: ECONOMIC, ENVIRONMENTAL AND SOCIAL IMPACTS
The proposed changes support the City's intent to ensure the public health, safety, and welfare related to residential rental occupancies.

STAFF RECOMMENDATION
Development Services staff recommends the passage and approval of proposed Ordinance changes.
